Justification

Probative capacity and the proper use of evidence necessarily require a foundation in evidentiary techniques, which are not necessarily the same in all areas of law.

The Diploma in Evidence Law It is specially designed to offer its attendees current practical knowledge for handling new forms of litigation in the administrative field; as well as litigation in the areas of Criminal Law, Civil Liability, Police Law, Administrative Law, Labor Law and Family Law.

This Diploma will allow the participant to accentuate the importance of the proper use and custody of evidence to achieve the final purpose that is: to impart justice; through the acquisition of knowledge of the Evidence System in Panama through the improvement and management of the different scenarios with the technical and scientific elements, which allow an analysis of the means of proof as appropriate; and the deepening of the aspects that make up the evidentiary law, creating a critical sense about the need to introduce more attention to these aspects both in the theory and in the practice of the administration of justice, teaching and learning of law.

General Objective

Update legal professionals in the knowledge and practice of handling judicial evidence and evidence in general during the process of demonstrating the truth of the occurrence of the facts.

Specific Objectives

  •  Know the importance of evidence, its nature, the different means of evidence and its application in different areas of law.
  • Update and deepen the notion of evidence, evidentiary principles, burden of proof, means and assessment of evidence in all areas of law.

    • Topic 1: Evidence Assessment Systems.
    • Topic 2: Evidence Activity and Evidence Assessment in the Civil Process
    • Topic 3: Classification of the Tests.
    • Topic 4: Procedural Aspects of the Evidence.

    • Topic 1: The Testimony (Techniques). Declaration of Party and Confession
    • Topic 2: Spontaneous and provoked confession
    • Topic 3: Judicial inspection and exhibitory evidence.
    • Topic 4: The Expert Evidence
  • Module 4 – 12 synchronous hours of tutoring plus 18 asynchronous hours of work – Total 30 hours
    • Topic 1: Documents. Test Assurances.
    • Topic 2: Indications and Presumptions.
    • Topic 3: The Scientific Test. The Electronic Evidence and its Assessment.
